1. Agreement to these terms

These Terms of Use (the “Terms”) govern your access to and use of this website, which is operated by Caymanians First Charitable Foundation (the “Foundation”, “we”, “us”, or “our”).

By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website. If you use the website on behalf of an organisation, you confirm that you have authority to act for that organisation.

3. Permitted use

You may access, view, and print pages from this website for lawful, personal, educational, or other non-commercial purposes, provided that you do not remove ownership notices or present the material in a misleading way.

You may link to publicly available pages on this website in a fair and lawful manner. A link must not suggest that the Foundation sponsors, endorses, or is formally associated with you unless we have agreed to that relationship in writing. You must not display this website within a frame or otherwise obscure its source.

4. Prohibited use

You must not:

  • use the website for an unlawful, fraudulent, abusive, or unauthorised purpose;
  • infringe another person’s rights, privacy, or intellectual property;
  • misrepresent your identity or your relationship with the Foundation;
  • introduce viruses, malicious code, or other harmful technology;
  • attempt to gain unauthorised access to the website, its server, or connected systems;
  • interfere with the website’s operation, security, or availability;
  • collect personal data from the website without a lawful basis; or
  • use automated tools in a manner that places an unreasonable burden on the website or circumvents access controls.

We may restrict or block access where we reasonably believe these Terms, applicable law, or the security of the website has been threatened.

5. Intellectual property

Unless otherwise stated, the website and its text, design, layout, graphics, logos, photographs, illustrations, video, audio, code, and other content are owned by or licensed to the Foundation and are protected by applicable intellectual-property laws.

The limited permission in section 3 does not transfer any ownership rights. You may not reproduce, adapt, distribute, publish, commercially exploit, or create derivative works from website content without prior written permission from the Foundation or the relevant third-party rights holder.

The names, logos, programme names, and other brand features displayed on this website may be trademarks or protected identifiers. You may not use them in a way that implies approval, sponsorship, or affiliation without written permission.

6. Information, eligibility, and no professional advice

Website content is provided for general information about the Foundation, its mission, and its current or proposed programmes. It is not legal, financial, tax, medical, investment, safeguarding, or other professional advice. You should obtain appropriate independent advice before acting on information where your circumstances require it.

Descriptions of grants, scholarships, accounts, training, partnerships, or other programmes do not guarantee eligibility, selection, funding, availability, timing, or a particular outcome. Formal application materials, eligibility rules, award documents, and programme-specific terms will take priority over general website content.

Statistics, projections, examples, and descriptions may be simplified or based on information available at the time of publication. Actual results and programme details may differ.

7. Donations, applications, and other services

As of the date of these Terms, this website does not process online donations, accept programme applications, create user accounts, or submit information entered into the displayed contact form.

If we introduce a donation facility, application portal, volunteer registration, account, or another interactive service, additional terms and notices may apply. Those specific terms will be presented with the relevant service and will control if they conflict with these general Terms.

A message, expression of interest, proposed donation, or application does not by itself create a contract, partnership, fiduciary relationship, funding commitment, or obligation on the Foundation.

8. Information you send us

You are responsible for ensuring that information you send to us is accurate, lawful, and does not infringe another person’s rights. Please do not send payment-card information, passwords, medical information, or other sensitive personal data through a general enquiry.

Sending material to the Foundation does not transfer your ownership of it. However, you give us permission to copy and use it as reasonably necessary to review and respond to your communication. We will seek separate permission before publicly using a person’s story, image, testimonial, or creative work unless another lawful basis applies.

9. Third-party websites and services

The website may link to or use websites, social-media platforms, payment providers, maps, videos, or other services operated by third parties. Links are provided for convenience and do not necessarily mean that we endorse or control the third party or its content.

Third-party services have their own terms and privacy practices. You access and use them at your own discretion, and the Foundation is not responsible for their availability, security, accuracy, or conduct.

10. Website availability and changes

We aim to keep the website useful and accurate, but we do not promise that it will always be available, uninterrupted, secure, complete, or error-free. We may change, suspend, or withdraw any part of the website without notice, including programme descriptions and external links.

You are responsible for using appropriate device security and virus protection when accessing or downloading material from the internet.

11. Disclaimers

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis. We disclaim warranties, representations, and conditions that may otherwise be implied, including as to accuracy, completeness, fitness for a particular purpose, non-infringement, availability, and freedom from harmful code.

Nothing in these Terms limits any responsibility that cannot lawfully be excluded or limited.

12. Limitation of liability

To the fullest extent permitted by law, the Foundation and its directors, officers, employees, volunteers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss or damage arising from or connected with your use of, inability to use, or reliance on the website or a linked third-party service.

This includes loss of data, opportunity, revenue, goodwill, or anticipated savings, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, even if the possibility of the loss was known. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

13. Privacy

Our Privacy Notice explains how we collect and use personal data through the website and related communications. It forms part of the information you should read when using this website.

14. Governing law and jurisdiction

These Terms and any dispute or claim arising from or connected with them or the website are governed by the laws of the Cayman Islands. The courts of the Cayman Islands will have exclusive jurisdiction, except where applicable law requires otherwise.

15. General terms

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. If we do not immediately enforce a provision, that does not waive our right to enforce it later.

These Terms, together with the notices and any service-specific terms expressly referred to in them, constitute the agreement relating to your general use of this website. They do not alter a separate written agreement between you and the Foundation.

16. Changes to these terms

We may update these Terms when the website, our services, or legal requirements change. The current version will be posted on this page with its “Last updated” date. Your continued use of the website after an update means that the revised Terms apply from that point.
